TREATMENT · CARE · RESPONSIBILITY

Medical &healthcare law

Respecting trust.
Clarifying responsibility.

Healthcare brings together personal concerns, professional responsibilities and operational duties. We assist patients, healthcare professionals and institutions with contracts, liability and the legal structuring of their cooperation.

Discuss your matter

Patients' rights. Care. Professional practice.

YOUR MATTER

Personally affected.
Professionally responsible.

Patients and practitioners view the same event from different perspectives. Relatives, institutions and businesses also have their own legal positions. We define the engagement and check for potential conflicts of interest before accepting instructions.

Patients & relatives

We assist with patients' rights, suspected treatment errors and legal questions about care. We advise relatives on their own rights or valid authority to represent a patient. Documents, the course of treatment and specific consequences are recorded carefully.

Healthcare professionals & practice owners

We assist with establishing and acquiring practices, cooperation arrangements, contracts and liability. Where allegations arise, we assess the practitioner's own legal position. Professional, corporate and employment matters are assigned to their respective legal levels.

Institutions & the healthcare sector

We assist hospitals, care facilities and businesses with contracts, organisation and regulatory issues. Responsibilities and processes matter alongside requirements for products and care. Necessary specialist input is coordinated for the particular project.

OUR SERVICES

From patients' rights
to organising care.

We assess the specific relationship between the parties. Treatment contracts, insurance, professional practice and regulatory requirements are considered together where your matter requires it.

Patients' rights and medical records

Assess information and self-determination in legal terms.

We assist patients with information, consent, documentation and access to medical records. We advise practitioners on the legal design of their procedures and handling related requests. We assess the specific circumstances and possible authority to act for another person. Relatives' rights are not automatically equated with those of the patient.

Patients' rights · Information · Consent · Medical records

Treatment errors and medical liability

Assess allegations, causes and consequences separately.

We assist patients in assessing possible liability claims and organising their evidence. We support healthcare professionals and institutions in defending claims made against them. We examine treatment, information given and the documented course of events. Medical questions may require expert assessment; legal responsibility, causation and loss are then assessed on that basis.

Medical liability · Treatment errors · Compensation for pain and suffering · Consequential loss

Practice establishment, acquisition and cooperation

Connect professional practice and business structure.

We advise outgoing practice owners on transfer, remaining obligations and safeguards. We assist purchasers with the scope of the contract, existing assets and legal requirements for continuing the practice. Cooperation agreements address contributions, responsibilities and termination. Tenancy, employment and authorisation issues are assessed separately and aligned with the intended timetable.

Practice acquisition · Establishing a practice · Cooperation · Handover

Hospitals, nursing care and healthcare provision

Organise contractual relationships and responsibilities.

We assist institutions with organisational, cooperation and care provision agreements. In separate engagements, we support patients and people requiring care with contractual questions and complaints about care. We advise relatives on their specific legal position. Residential care contracts, benefit claims against a funding body and possible liability are addressed as separate issues.

Professional regulation and authorisation

Support professional practice through the appropriate procedure.

We advise healthcare professionals and institutions on professional requirements and authorisation for their activities. For objections or decisions, we assess the grounds, competent authority and possible responses. Practice succession, replacement appointments and cooperation are aligned with the required procedures. The specific professional and state-law framework and any additional specialist assessment are clarified at the outset.

Professional regulation · Authorisation · Statutory health insurance physician law · Replacement appointments

Funding bodies and expert reports

Distinguish benefit decisions from their expert basis.

We assist insured persons with legal review of decisions on care or reimbursement. We advise service providers on billing and remuneration disputes within their own contractual or care framework. We assess the reasons given and the significance of existing expert reports. Statutory insurance, private insurance and direct treatment billing are each considered separately.

Funding bodies · Expert reports · Medical Service · Remuneration

Medicinal products, medical devices and pharmacies

Identify the legal framework for the product and activity.

We assist healthcare businesses with contractual and regulatory issues concerning their products and services. Manufacturers, distributors, operators and pharmacies have different duties. We establish the specific product, intended use and your role. Medicinal products, medical devices and pharmacy law are assessed separately; technical, pharmaceutical or specialist authorisation input is coordinated separately where required.

Digital healthcare and new services

Integrate innovation into existing responsibilities.

We assist practices, institutions and providers with contracts and legal questions concerning digital health services. We assess the proposed process, the roles involved and the handling of health data. Telemedicine, electronic records and AI may trigger different additional requirements. Medical suitability and technical security are assessed by specialists; we clarify the legal duties.

WORKING TOGETHER

From your concern
to your next decision.

We clarify the legal issue and the medical or operational documents needed. Protecting sensitive information forms part of preparing to work together.

  1. Understand the role and history

We identify the parties, treatment or project and the course of events. Deadlines, authority to represent others and available documents are clarified first.

  2. Connect legal and specialist questions

We assess the initial legal position and determine the expert evaluations required. We agree the scope of the engagement, document transmission and costs.

  3. Structure arrangements or represent interests

We assist with contracts and organisation or represent your position in a dispute. Expert reports and new findings inform the next steps.

QUESTIONS & ANSWERS

Initial
Guidance.

An initial guide to common questions. Your legal position, the documents and the facts determine the assessment of your individual case.

Legal information: 1 November 2026

Can a patient inspect their medical records?

The law generally provides a right to prompt access to one's own complete medical records and to copies. Statutory exceptions and other people's rights must be observed. We assist with requests and advise practitioners on handling them lawfully.

Does a poor treatment outcome prove an error?

No. The treatment outcome, breach of duty and causal link must be assessed separately. The law contains specific burden-of-proof rules for treatment errors and failures to inform. We review records and existing expert reports and clarify what further expert assessment is needed.

Does a signed form replace the discussion needed for informed consent?

The information required by law must generally be provided orally, in good time and in an understandable way; documents may supplement it. The content and circumstances of the specific discussion are decisive. Special situations and statutory exceptions are assessed separately.

Do you also defend doctors and institutions against liability allegations?

Yes. We assess the allegation, documentation, alleged consequences and possible defences from the instructing client's perspective. Insurance issues are considered separately. This does not involve representing opposing interests in the same matter at the same time.

Can relatives automatically act for a patient?

A family relationship does not automatically replace the necessary authority. We clarify powers of attorney, statutory representation or relatives' own rights. The patient's wishes and legal position remain the starting point.

Do you advise on the legal aspects of a practice acquisition?

Yes. We assess the proposed acquisition or transfer and related contracts. Authorisation, tenancy, staffing and data protection issues are considered in their proper context. Specialist assessments and tax advice are coordinated separately.

Do you prepare medical expert reports yourselves?

Our role is legal assessment and representation. Medical questions are assessed by qualified experts. We clarify which questions are decisive for the engagement and how existing or additional expert reports should be evaluated legally.
