YOUR MATTER
Tenants and landlords have different obligations and protective rights. Within an owners' association, too, the interests of an individual owner, the association and the property manager do not automatically coincide.
We advise either party in residential tenancy matters under the relevant engagement. For tenants, use, costs and security of tenure may be central; for landlords, contract drafting, maintenance and enforcement of agreed obligations. The specific engagement determines whom we represent.
We assist commercial tenants, landlords, lessors and lessees with premises and use agreements. Term, operations, alterations and return are aligned with the relevant activity. We also help institutions and institutional occupiers address their particular premises requirements.
We advise individual condominium owners, owners' associations and property managers on resolutions, maintenance, costs and responsibilities. Before instruction, we clarify who the client is and who is authorised to make the necessary decisions. Personal interests and association matters are assessed separately.

We structure arrangements for use and support ongoing cooperation. Residential tenancies, commercial tenancies, leases granting rights to income or produce, and condominium ownership are assessed according to their respective requirements.
Making the tenancy clear from the outset.
We assist landlords with contract drafting, agreed use, security and handover. We advise tenants on proposed clauses, costs and obligations during the tenancy. We also assess stepped and index-linked rents, fixed terms and agreements on decorative repairs under the applicable rules. Later amendments and arrangements should fit the existing contract. In disputes, we consider the specific housing situation and the legal interests of the party we represent.
Connecting use, term and investment.
We advise commercial tenants on permitted use, alterations, renewal options and the financial commitments of a location. We help landlords define services, security, adjustments and return obligations. We assess operating obligations, maintenance and cost allocation in light of the specific property. For offices, retail, production or institutional facilities, we assist with negotiating a sound contract and later amendments.
Correctly allocating space, operations and income.
We assist lessees with permitted uses, inventory taken over and investment in the business. We advise lessors on maintenance, remuneration and return. We examine which rights and operating assets are made available and which obligations apply during the term. Adjustments, subletting and the end of the agreement are assessed for the party we represent. Agricultural requirements or other business-related provisions are included in the agreed review scope where needed.
Understanding demands and accounts.
We assist landlords with rent adjustments and with assessing or enforcing payment claims. We advise tenants on requested increases, operating cost statements and possible objections. We consider contractual provisions, supporting records, allocation methods and timing requirements together. We distinguish residential from commercial use and assess which costs have been validly agreed. In disputes, we assist with clarification and an appropriate accounting solution.
Documenting impairment. Clarifying duties.
We assist tenants with defect notifications, impaired use and assessment of possible rights. We advise landlords on the remedy owed, organising works and handling claims. The cause, extent and duration of an impairment must be substantiated clearly. We assess maintenance, modernisation and duties to cooperate, and examine possible cost or compensation claims. Technical questions are assessed separately by experts where needed.
Assessing the end of the contract and continued use legally.
We advise landlords on the requirements, form and consequences of termination and on enforcing claims for return of premises. We help tenants review termination notices, possible objections and the next steps. This also includes termination by agreement, handover, deposits and outstanding payments. Different requirements apply to residential and commercial premises. We conduct negotiations or proceedings from the perspective of the party instructing us.
Coordinating individual rights and association responsibilities.
We advise condominium owners on voting rights, cost allocation and review of resolutions. We help associations prepare and legally assess their decisions. We review declarations of division, community rules and resolution documents, and advise on maintenance and structural alterations. In a dispute, we clarify the correct defendant and possible procedural steps. Representation of an individual owner is separate from an engagement by the association.
Clearly allocating instructions, powers and accountability.
We assist owners and associations with management agreements, appointment, supervision and possible replacement of the manager. We advise property managers under their own engagement on powers, remuneration and liability claims brought against them. We review documentation, accounts and the legal implementation of measures adopted by resolution. We distinguish tenancy management from condominium management. In disputes over documents, payments or responsibilities, we represent the specific party instructing us.

Either party may instruct us separately. Before accepting an engagement, we clarify whose interests we represent and whether there is a conflict with existing engagements. For condominium matters, we also distinguish individual interests, an engagement by the association and separate instructions from the manager.
No. Whether and to what extent rent is reduced depends particularly on impairment of the agreed use; insignificant restrictions are disregarded. The extent, period and further requirements must be assessed. We advise tenants on their rights and landlords on rent reduction claims made against them.
Defects arising during the tenancy must generally be reported to the landlord without delay. Failure to report may result in liability for loss and restrict rights. The timing, content and proof of notification are therefore important. Landlords should record receipt and assess the response required.
An action challenging a resolution must generally be brought within one month of its adoption, with grounds submitted within two months of adoption. The relevant date is therefore not the later receipt of the minutes. Questions of nullity and possible exceptions must be assessed separately. An enquiry to the firm does not preserve these deadlines.
The statutory actions concerning resolutions are brought against the condominium owners' association. A dispute with individual owners or the manager does not therefore automatically make them the correct defendant. We assess the type of action, the parties and authority to instruct before proceeding.
Yes. For commercial use, we consider in particular the contractual purpose, term, costs, alterations, cooperation and return. For leases granting rights to income or produce, we also clarify which income rights and operating assets are included. Residential tenancy rules are not applied without examination.
Yes. Depending on the matter, an amendment to the contract, a payment or maintenance agreement, termination by agreement or another arrangement may be possible. We assess whether negotiations are worthwhile and which deadlines must be protected alongside them. Settlement requires the agreement of the parties involved.
