Advance planning &court-appointed legal support

Recording your wishes.
Enabling action.

Who should act when support is needed, and which wishes should guide them? We structure personal and business advance planning and assist with legal questions concerning powers of attorney, directives and court-appointed legal support.

Discuss your matter

Personal wishes. Clear authority. Legal support.

YOUR MATTER

Deciding for yourself.
Allocating responsibility.

The wishes of the person concerned are central. Authorised representatives, court-appointed representatives, family members and institutions have different tasks and powers. We clarify the respective role in the engagement and the limits of representation.

People Planning Ahead & Affected Individuals

We help you record personal wishes and representation arrangements. Where court-appointed legal support exists or has been proposed, we assess your rights and specific support needs. Self-determination and actual living circumstances are the starting point.

Authorised Representatives & Family Members

We support authorised representatives with the scope, exercise and proof of their powers. We advise family members on their own legal position. Closeness to the person concerned does not automatically confer every power of representation; differing interests are carefully distinguished.

Businesses & Institutions

We help business owners coordinate personal and business advance planning. We advise institutions on handling powers of attorney and representation situations. Personal wishes, responsibilities and required evidence must fit together in the particular case.

OUR SERVICES

From your own decision
to effective representation.

We prepare advance-planning documents and assist with questions about their use. Legal advice, medical information and decisions of the court responsible for adult legal support each retain their distinct function.

Precautionary and General Powers of Attorney

Defining powers to meet your own needs.

We advise those granting powers of attorney on choosing a representative, tasks, limits and oversight. We help authorised representatives interpret, prove and use an existing power. We distinguish authority to act towards third parties from internal arrangements. The scope, form and coordination with banking, property or business matters are assessed for the particular case.

Advance Healthcare Directives and Treatment Wishes

Expressing personal wishes for treatment situations.

We help people planning ahead put their treatment wishes into legal form. We advise authorised or court-appointed representatives on applying a directive in a particular situation. We focus on clear provisions and their interaction with powers of representation. Medical questions should be clarified with treating professionals; our role is legal drafting and support.

Directive on court-appointed support

Recording wishes for a possible court appointment.

We advise people planning ahead on personal wishes concerning the selection and work of a court-appointed representative. We help nominated trusted individuals understand the proposed role. We align the directive with existing powers of attorney and living circumstances. A directive concerning court-appointed legal support is distinct from a power of attorney; it does not itself replace a court appointment.

Court-Appointed Legal Support and Proceedings

Assessing necessity, scope and personal rights.

We support affected individuals with questions concerning the appointment, scope or modification of court-appointed legal support. We advise family members and existing court-appointed representatives, each under their own engagement, on their procedural position. We review documents, areas of responsibility and possible objections. The person's wishes and other available assistance are taken into account in the legal assessment.

Exercise and Supervision of Powers of Attorney

Connecting trust with clear accountability.

We support those granting powers of attorney with reports, accounts and possible changes to or termination of authority. We advise authorised representatives on responding to allegations and documenting their actions. Where specific doubts arise about the use of a power, we assess legal options and responsibilities. Personal disputes are distinguished from demonstrable breaches of duty.

Supervision of Powers of Attorney · Accountability · Revocation · Documentation

Financial Affairs and Approvals

Preparing transactions within the scope of authority.

We advise affected individuals, authorised representatives and court-appointed representatives, each in their own role, on financial decisions. We review the scope of representation, existing restrictions and possible approval requirements, for example for property or long-term commitments. We also help business partners assess evidence of authority presented to them. The specific basis for representation is clarified before a binding declaration is made.

Business contingency planning

Connecting personal advance planning with business continuity.

We advise business owners on which decisions must remain possible if they become unable to act. We support companies with responsibilities and representation rules, and nominated trusted individuals with their legal role. Powers of attorney, constitutional documents and the powers of corporate bodies are aligned. A private general power of attorney does not automatically replace the requirements of the particular business structure.

Institutions and Representation Issues

Clarifying everyday responsibilities reliably.

We advise institutions on assessing powers of attorney and evidence of court-appointed representation in legal terms. We support affected individuals and their representatives with recognition of their authority and coordination of necessary declarations. We examine the specific decision, documented wishes and responsibility. Personal wishes must not be replaced by purely organisational assumptions.

WORKING TOGETHER

From your concern
to your next decision.

We start with your wishes and the actual situation. Drafting advance-planning documents requires different steps from an urgent dispute over representation or court-appointed legal support.

  1. Clarifying Wishes and Responsibilities

We discuss the person concerned, existing arrangements and your role. In ongoing proceedings, we assess dates and urgent decisions ahead.

  2. Reviewing and Coordinating Arrangements

We review existing documents or develop suitable drafts. Form, scope of representation, further specialist input and remuneration are agreed with you.

  3. Implementing Documents and Providing Support

We support legal implementation or the agreed proceedings. Any required notarial, medical or court steps remain separately assigned.

Legal information: 1 November 2026

Does a power of attorney prevent court-appointed legal support in every case?

Not necessarily. Court-appointed legal support may be ordered only where necessary. A suitable authorised representative or other assistance may remove that necessity. Whether an existing power of attorney is sufficient and can actually be used must be assessed in each case.

Can a representative be appointed against a person's free will?

The law rules out an appointment against an adult's free will. The statutory requirements and specific support needs must also be assessed. We help affected individuals exercise their procedural rights and assess the documents available.

What is the difference between an advance healthcare directive and a precautionary power of attorney?

An advance healthcare directive records your own decisions for particular treatment situations. A power of attorney determines who may represent you within the agreed scope. Applying these documents involves checking, among other things, whether the instructions fit the current living and treatment situation. The two documents should be coordinated.

Can an advance healthcare directive be revoked?

An advance healthcare directive can be revoked at any time without formal requirements. Changes should be communicated and documented so that those involved can recognise the person's current wishes. The medical situation and legal representation issues must be distinguished.

Is general wording sufficient for every power of attorney?

No. For certain particularly intrusive measures, the law requires a written power of attorney that expressly covers them. In other cases too, the appropriate form depends on the intended transactions. We assess the specific needs and coordinate any required certification or notarisation separately.

Do you also advise authorised representatives and institutions?

Yes. We clarify in advance who we represent and which decision is pending. We assess the scope and evidence of authority, as well as the wishes of the person concerned. Joint advice to several participants requires their interests to be compatible.

Can business advance planning be included?

Yes. Private powers of attorney, business responsibilities and corporate powers are considered together. We assess which decisions should remain possible during an absence or incapacity and which arrangements must be aligned for this purpose.
