Liability &damages

Clarifying the connections.
Representing claims on a sound basis.

Loss or injury raises questions of cause, responsibility and appropriate compensation. We assist injured parties as well as individuals and organisations facing claims, examining the claim, the evidence and the opposing position.

Discuss your matter

Responsibility. Evidence. Representation.

YOUR MATTER

Claiming compensation.
Assessing demands.

An alleged loss and a legal obligation to compensate are not the same thing. We consider the facts from your specific position and distinguish the basis of liability, the amount of loss and the options for enforcement.

Injured parties & relatives

We assess compensation claims for personal injury, property damage and financial loss. We establish the evidence, possible subsequent effects and the position of other parties. We assist relatives with their own rights or with validly representing the person affected.

Businesses & responsible individuals

We advise on losses arising in a business or professional context. We assess both your own claims and the defence of claims brought against you. Contracts, organisational arrangements and possible insurance are considered in relation to the specific responsibility involved.

Institutions & defendants

We help assess allegations of liability and possible compensation claims belonging to your organisation. Responsibilities, documentation and particular legal standards are considered separately. We align communications and the next steps with the actual position.

OUR SERVICES

From the cause
to possible compensation.

The assessment follows the specific event causing the loss. We clarify the basis on which a party may be responsible and which consequences can be proved and legally attributed to it.

Liability and compensation

Assessing responsibility on the correct legal basis.

We help injured parties assess contractual and statutory compensation claims. We advise those facing claims on objections to their basis and amount. We examine duties, actual conduct and the connection with the loss. We also consider multiple parties, particular liability standards and possible contributory responsibility.

Compensation · Breach of duty · Cause · Basis of liability

Personal injury and compensation for pain and suffering

Carefully documenting the effects on health.

We help injured individuals prepare the legal basis of their claims and record further consequences. We help defendants assess the alleged injury and its connection to the incident. Treatment, lost earnings and support needs are considered separately. Medical assessments are provided by qualified specialists; we place them in context for the legal assessment.

Personal injury · Compensation for pain and suffering · Lost earnings · Consequential loss

Property damage and financial loss

Distinguishing the amount of loss from its recoverability.

We assist owners and other entitled parties with damage to property and resulting financial losses. We advise defendants on reviewing repair costs, valuations and alleged consequential losses. We clarify who holds the claim and which items can be substantiated. Existing contracts and possible mitigation of loss are taken into account.

Property damage · Financial loss · Repair · Consequential loss

Product and manufacturer liability

Identifying the product, defect and responsible parties.

We advise injured parties on possible claims relating to a defective product. We help manufacturers, distributors and other parties assess claims brought against them. We examine product documentation, use and the development of the loss. We distinguish statutory product liability, other bases of liability and contractual defect rights; technical questions may require expert assessment.

Product liability · Product defect · Manufacturer · Distributor

Professional liability

Separating the engagement, professional standard and outcome.

We help clients assess possible errors in a professional service. We advise professionals on defending unfounded or excessive claims. We establish the engagement, the work owed, documentation and alleged loss. An undesired outcome alone does not determine liability. Insurance and other specialist issues are coordinated separately.

Professional liability · Advice · Engagement · Documentation

Public authority liability and public responsibility

Legally assessing the exercise of public authority.

We advise affected parties on possible compensation claims arising from state action. We assist public bodies under their own engagement with assessing claims brought against them. We consider the action, the duty concerned, the correct defendant and the loss. Legal protection against an administrative measure must be distinguished from a possible compensation claim; the timing of both may interact.

Public authority liability · Public sector · Duty · Legal protection

Debt recovery and defence of claims

Pursuing justified claims with clear supporting grounds.

We help creditors prepare and pursue outstanding payment claims. We advise debtors on assessing the basis and amount of claims and possible objections. We reconcile contracts, invoices, evidence of performance and payments. We assess out-of-court steps and court options in light of the evidence, costs and commercial objective.

Debt recovery · Payment · Payment reminder · Objections

Enforcement and recovery

Considering enforceable titles and practical options together.

We assist holders of enforceable titles in selecting and preparing appropriate enforcement steps. We help affected debtors assess specific measures and possible objections. We clarify the title, service, previous steps and available information. Legal enforceability and the practical recoverability of a claim are assessed separately.

Enforcement · Enforceable title · Attachment · Recovery

WORKING TOGETHER

From your concern
to your next decision.

We start with the incident and the available evidence. Responsibility, loss and enforceability are assessed in clear steps.

  1. Recording the incident and evidence

We establish the parties involved, the timeline and the consequences. We clarify current deadlines, insurance and statements already made.

  2. Assessing the claim and opposing position

We examine the legal basis and individual heads of loss. We agree on evidential requirements, expert input and costs.

  3. Negotiating and pursuing targeted recovery

We represent your position out of court or in the agreed proceedings. Settlement proposals and possible enforcement steps are assessed separately.

QUESTIONS & ANSWERS

Initial
Guidance.

An initial guide to common questions. Your legal position, the documents and the facts determine the assessment of your individual case.

Legal information: 1 November 2026

Does every loss automatically give rise to a compensation claim?

No. An applicable legal basis and its requirements are necessary. These may include a breach of duty, fault and a causal connection; specific liability rules may differ. We therefore assess the basis of liability and the loss separately.

When is compensation for pain and suffering available?

Financial compensation for non-financial harm is available only in cases provided for by law. These include, in particular, certain infringements of bodily integrity, health, freedom or sexual self-determination. Entitlement and amount are assessed in light of the specific harm suffered.

Can my own conduct affect a claim?

Yes. Contributory responsibility and issues of preventing or mitigating loss may affect the basis and extent of compensation. The consequences depend on the specific events and the contributions of both sides. No general percentage can be inferred from this.

Do you also represent people accused of causing loss or injury?

Yes. We assess the alleged responsibility, individual heads of claim and possible objections. We take account of existing insurance cover and coordination with the insurer. The engagement is handled from your own legal position.

Is an expert report always necessary?

That depends on which facts are disputed and which specialist questions are decisive. Technical, medical or financial assessments may require expert assistance. We clarify the need and discuss the approach before such costs are incurred.

Should a settlement offer be accepted immediately?

A final agreement may also cover further consequences or those that emerge later. We therefore examine its terms, reservations and the known course of the loss. Whether an offer is appropriate is assessed in light of your specific circumstances and the intended scope of its binding effect.

Does a judgment guarantee that the claim will be paid?

An enforceable title provides a legal basis for further enforcement. Whether a claim can actually be recovered also depends on the enforcement options and the debtor's financial position. We take these issues into account when deciding on further steps.
